Gessele v. Jack in the Box Inc.

After the trial in this case in October 2022, and after post-judgment motions, the court has entered a Judgment in favor of Plaintiffs and the class members. With interest, that Judgment now totals over $15 Million. Both the class and Jack in the Box filed notices of appeal to the Ninth Circuit Court of Appeals, and the appeal has been fully briefed. We are waiting for the Ninth Circuit to set an oral argument date (the court has postponed our setting dates several times). There is not yet any money to disburse to class members, but Jack in the Box has posted a bond with the court to ensure that the Judgment can be paid once the appeal is resolved.
